Please read these Terms and Conditions ("Terms") carefully before using the services provided by YYC Pest Control ("we," "our," or "us"). By accessing our website or booking our pest control services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Definitions

  • "Company," "We," "Us," "Our" refers to YYC Pest Control, operating in Calgary, Alberta.
  • "Client," "You," "Your" refers to the individual or entity using our services.
  • "Services" refers to all pest control treatments, inspections, consultations, and related services provided by YYC Pest Control.
  • "Property" refers to the residential or commercial location where services are performed.
  • "Agreement" refers to these Terms and Conditions along with any service contract or quote.

2. Service Agreement

By booking our services, you agree to the following:

  • You are at least 18 years of age and legally capable of entering into a binding agreement.
  • You have the legal right to authorize pest control treatments at the service property.
  • You will provide accurate and complete information about your pest problem, property, and contact details.
  • You will provide safe and unobstructed access to all areas requiring treatment.
  • You will inform us of any known allergies, health conditions, or special circumstances before treatment begins.

3. Service Estimates & Quotes

  • All quotes and estimates are valid for 30 days from the date of issue unless otherwise stated.
  • Quotes are based on information provided by the client and a visual inspection where applicable.
  • Additional charges may apply if the scope of work changes or if unforeseen pest activity is discovered during treatment.
  • We reserve the right to revise quotes if the property conditions differ from what was initially described or observed.

4. Payment Terms

  • Payment is due upon completion of services unless otherwise agreed in writing.
  • We accept cash, credit cards, debit cards, and e-transfers.
  • For commercial or recurring services, payment terms will be outlined in a separate service agreement.
  • Late payments may be subject to interest charges of 2% per month (24% annually) on outstanding balances.
  • Returned cheques or failed payments will incur a $50 administrative fee.

5. Cancellation & Rescheduling

  • We require at least 24 hours' notice for appointment cancellations or rescheduling.
  • Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of $75.
  • Same-day cancellations or no-shows may be charged the full service amount.
  • We reserve the right to reschedule appointments due to weather conditions, emergencies, or unforeseen circumstances at no charge to you.

6. Service Warranty & Guarantee

  • We provide a warranty on all pest control treatments as specified in your service agreement.
  • Our warranty covers re-treatment at no additional cost if pests return within the warranty period, subject to the terms below.
  • The warranty is void if:
    • The client fails to follow post-treatment instructions or prevention recommendations.
    • New pest infestations occur from external sources beyond our control.
    • Structural changes, renovations, or new construction introduce new pest entry points.
    • The client introduces infested items (furniture, boxes, etc.) after treatment.
  • Warranty periods vary by pest type and will be clearly stated in your service documentation.

7. Client Responsibilities

To ensure effective treatment, you agree to:

  • Follow all preparation instructions provided before treatment (e.g., clearing areas, covering food, removing pets).
  • Provide access to all areas requiring treatment, including attics, crawl spaces, basements, and exterior areas.
  • Inform all occupants of the scheduled treatment and any safety precautions.
  • Keep children and pets away from treated areas for the recommended time period.
  • Report any pest activity during the warranty period promptly.
  • Maintain reasonable sanitation and structural integrity to prevent re-infestation.

8. Safety & Health Precautions

  • All products used are Health Canada-approved and applied by licensed technicians.
  • You will be provided with safety information, including re-entry times and any necessary precautions.
  • If you or any occupant experiences an adverse reaction, seek medical attention immediately and notify us within 24 hours.
  • We are not responsible for reactions resulting from failure to follow safety instructions or from undisclosed medical conditions.
  • Pregnant women, infants, elderly individuals, and those with respiratory conditions should consult their physician before treatment and follow our technician's specific guidance.

9. Limitation of Liability

  • YYC Pest Control shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
  • Our total liability for any claim related to our services shall not exceed the amount paid for the specific service in question.
  • We are not responsible for:
    • Damage caused by pests prior to treatment.
    • Pre-existing structural conditions or defects.
    • Damage resulting from client's failure to follow instructions.
    • Stains or discoloration from pest activity or treatment in pre-damaged areas.
  • We carry comprehensive liability insurance. Proof of insurance is available upon request.

10. Intellectual Property

  • All content on our website, including text, images, logos, and trademarks, is the property of YYC Pest Control.
  • You may not reproduce, distribute, or use any content from our website without prior written permission.
  • YYC Pest Control and our logo are trademarks of our company and may not be used without authorization.

11. Privacy & Data Protection

  • We collect and use personal information in accordance with our Privacy Policy and applicable Canadian privacy laws.
  • We may take photographs of pest activity and treatment areas for documentation and quality assurance purposes.
  • Your contact information will not be sold or shared with third parties for marketing purposes.

12. Complaints & Dispute Resolution

  • If you are unsatisfied with our services, please contact us within 7 days of treatment to discuss your concerns.
  • We will make every effort to resolve complaints promptly and fairly.
  • Any disputes arising from these Terms shall be governed by the laws of the Province of Alberta.
  • Both parties agree to attempt mediation before pursuing legal action.

13. Changes to Terms & Conditions

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Termination of Services

  • We reserve the right to refuse or terminate services if:
    • The client provides false or misleading information.
    • The property presents safety hazards to our technicians.
    • Payment for previous services remains outstanding.
    • The client violates these Terms and Conditions.
  • Clients may terminate recurring service agreements with 30 days' written notice.

15. Force Majeure

We shall not be liable for any failure or delay in performing our services due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government restrictions, or other unforeseen events.
